These Terms of Use are a legally binding Agreement (the Agreement) between Guardianangeldating.com (GAD Ltd.) and you for the service they provide.
GAD Ltd. reserve the right to amend this Agreement from time to time and the amended Agreement shall be published on our web site. If the Agreement is amended then the amended version shall supersede all earlier versions and the version currently published on the GAD Ltd. web site shall form the sole and exclusive Agreement between GAD Ltd. and the user.
If you do not agree to this Agreement (as amended from time to time) then you cannot use this web site.
This Agreement shall come into effect when, having completed a profile to become a member of the web site on the joining page, you press the "Join Now" button that appears at the bottom of that page.
The Service
The service GAD Ltd. provides includes but is not limited to, that of allowing you to publish a profile on this web site describing yourself, browse the profiles of other users of the web site, and send messages to and receive messages from other users of the web site.
The cost of the service GAD Ltd. provides and the period for which it is provided are explained on the web page called "Subscriptions" as amended from time to time. The payment methods GAD Ltd. accept are only those outlined on the aforementioned web page. Many parts of the service GAD Ltd. supply are free.
GAD Ltd. shall use all reasonable efforts not to disclose to any third party your real name, email address or any information that may enable you to be identified except as GAD Ltd. may be required to by law.
GAD Ltd. reserves the right to:
- amend the service they provide from time to time;
- suspend the service from time to time for business or for technical reasons;
- terminate the service at any time;
- refuse new members or subsequently cancel membership of existing members whether or not payment has been made for the service;
- suspend or terminate your access to the service without notice.
Your Certification
You certify that:
- you are 18 years of age or over;
- you are genuinely seeking friendship and/or a relationship;
- you accept that other people using the web site will be able to view your profile and send you messages via the web site;
- you accept that we may place a link directly to your profile from the home page of the web site;
- you accept that we may place a link directly to your profile from any Internet (on-line only) marketing material that may be distributed round the Internet;
- you accept that if you disclose personal information in your profile or in messages sent to other people using the web site then you do so entirely at your own risk;
- you will not use this web site for commercial purposes;
- you will not use this web site to recruit its members to form another community, online or otherwise, whether for profit or not, anyone suspected of this will be deleted from our site with immediatte effect;
- you will not use this web site to send junk mail;
- you will not use this web site in a manner which may cause offence to another person using this web site;
- the information you include in your profile is a true representation or likeness of you;
- you own the copyright to text or photographs you include in your profile and assign that copyright to GAD Ltd.;
- you give your permission for any photographs taken of you at meetings arranged through our message boards or otherwise to be published on our website;
- you will not include photographs of children in your profile;
- you will not include any information in your profile that would facilitate direct contact with other members, including but not limited to your address, your email address, your telephone number or a web address;
- you will not include your membership status of this web site in your profile;
- you will not include in any message you send to another user of this web site any information which is contrary to any law or which invades the privacy of any other party;
- you accept that we may at our sole discretion and without notifying you edit or delete your profile, or open, edit or delete any messages you send or receive if we see fit to do so for whatever reason;
- you will not allow another person to use this web site by virtue of making available to them your username and password;
- you will not copy and you will keep confidential any information published on this web site including but not limited to the information contained in profiles of other people using this web site;
- you will not publish duplicate profiles on this web site;
- you will not use your credit card to pay for another user of this web site to upgrade their membership nor allow another person to use their credit card to pay for you to upgrade your membership;
- if you arrange to meet anyone through this web site then you do so entirely at your own risk.
- GAD Ltd. may show your site username on other members' Reverse Shortcuts when you add them to your own Shortcuts (these being convenient links to profiles members like to make note of).
- GAD Ltd. may email other members to inform them that you have added them to your Shortcuts.
- GAD Ltd. may display photographs of you on the website taken by you or another member at one of the events arranged on the Message Board (unless you email GAD Ltd. quoting specific photo reference numbers appearing against such photos being displayed and ask GAD Ltd. to delete them).
- GAD Ltd. may record your I.P address and the link URL (if any) via which you found the website.
Advertisements and Third Party Links
GAD Ltd. allows advertisements on the Site, but strives to make sure they are clearly marked as Advertisements. Advertisements found on the site do not express the views or opinions of GAD Ltd. The Site may provide links to third-party web sites. GAD Ltd. does not recommend, monitor, control or endorse any third party advertising or content, nor the content on any third-party web sites and is not responsible for their terms of use or privacy policies or how they may treat your information. Your use of third-party web sites is at your own risk. Dealings you have with advertisers found on the Site are between you and the advertiser, and you acknowledge and agree that we are not liable for any loss or claim you may have against an advertiser.
Guarantee, Indemnity and Liability
GAD Ltd. does not guarantee the accuracy of any information contained in this web site that is supplied by other users of the web site nor do they guarantee any results from the service.
You will indemnify GAD Ltd., our officers and employees from any claim made arising from your breach of this Agreement or from your conduct whilst using this web site.
GAD Ltd. shall not be liable to you for any damages of any kind arising out of the use of the service including but not limited to the misuse of your personal information by other users of this web site, except insofar as by law GAD Ltd. are not permitted to exclude liability. Your statutory rights remain unaffected.
Termination
Either party may terminate this Agreement at any time for any reason. If you wish to terminate this Agreement you can either do so (A) by following the link to remove your profile (within the Profile / Setting section after logging in), or (C) by emailing GAD Ltd. via the web form on the "Contact Us" web page from the email address (as amended by you from time to time) you supplied to GAD Ltd. and, if they request it, supply sufficient information to GAD Ltd. so that they are able to identify your profile. Refunds will only be given at the discretion of GAD Ltd.
Jurisdiction
This Agreement is governed by English law and should any part of them be found to be unenforceable then the remainder shall still apply.
